Terms of Use & Rental
These terms govern every booking, rental, and use of the driveup.gr website. Please read them carefully before making a reservation.
General Terms & Acceptance
DriveUp.gr ("the Company", a trademark of the sole proprietorship "Dimitrios Polychronis of Eleftherios", registered with G.E.MI. / OBI) provides vehicle rental services in Mytilene, Lesvos. By browsing, booking, or using any of our services, the user unconditionally accepts these Terms in full.
If the user does not agree with any part of these Terms, they must refrain from using our website and services.
Exclusive Booking Channel
All vehicle rental bookings are made exclusively through the official driveup.gr website or, alternatively, through confirmed written/electronic communication with the Company (email or phone number listed under "Contact"). A booking that has not been made or confirmed through these official channels does not bind the Company and is not recognized as valid.
The Company bears no responsibility for bookings, promises, or agreements purportedly made through third-party platforms, intermediaries, social media, or verbal arrangements, unless confirmed in writing by the Company.
Booking, Cancellation & No-Show Policy
- Every booking is subject to fleet availability and is only finalized upon written confirmation (email) from the Company.
- The customer must provide accurate, complete, and truthful information at booking. False or incomplete information entitles the Company to cancel immediately without refunding any deposit.
- Cancellations made up to 48 hours before pickup: full refund of any deposit, unless otherwise agreed at booking. Cancellation within 48 hours or a no-show results in forfeiture of the deposit as reasonable booking compensation.
- The Company reserves the right to refuse or cancel a booking for safety reasons, unavailability, or well-founded suspicion of fraud.
- Prepayment & finalization: A provisional vehicle hold (e.g. following an availability-confirmation email) does not constitute a final booking. A booking becomes final and binding on the Company once the Company sends a final confirmation email. Where the Company has requested a deposit/prepayment (e.g. in peak season), the booking becomes final only once that payment has been received within the stated deadline. Until then, the vehicle remains available and the Company bears no liability should it be allocated to another customer.
- Exclusivity of a confirmed booking: Once final written confirmation has been sent by the Company (and, where requested, prepayment has been received), the booking is reserved exclusively for the specific customer/driver named. This booking may not be cancelled, modified, transferred, or reassigned by any third party (including travel agencies, agents, intermediaries, or partners through whom the request may have been forwarded), except with the express written consent of both the customer and the Company.
Renter Requirements
- The renter and every declared driver must be between 23 and 70 years of age, holding a valid driving licence for at least 1 year. The Company is entitled to refuse rental to a person outside this age range, or to impose additional conditions/charges on a case-by-case basis.
- A valid driving licence and ID/passport in the driver's name must be presented at pickup.
- Non-EU customers may be required to present an International Driving Permit in accordance with Greek law.
Pickup, Return & Fuel Policy
- The vehicle is delivered with, and must be returned at, a half-full tank ("half-to-half"), unless otherwise agreed at pickup. Returning with less fuel than agreed is charged to the customer at refuelling cost plus a reasonable service fee.
- Late return without prior arrangement is charged an additional daily rental rate per hour or fraction of a day of delay.
- A vehicle condition report (with photographic documentation) is completed at pickup and return, serving as evidence of any damage.
Insurance & Damage Liability
Every vehicle carries mandatory third-party liability insurance. The renter remains liable for the contractual excess amount in case of damage, theft, or accident, as specified in the rental agreement, unless zero-excess additional cover has been purchased. Damage arising from negligence, breach of these Terms, driving under the influence of alcohol/substances, or unauthorized use is not covered by any insurance and is borne entirely by the renter.
Additional Damage Cover (CDW / FDW)
The Company optionally offers, for an additional fee, two supplementary damage cover packages beyond the mandatory third-party liability insurance. These packages constitute a contractual limitation of the renter's liability towards the Company and are not an insurance product provided by a third-party insurer.
The Company itself assumes the cost of vehicle damage regardless of fault, beyond the 500€ excess amount. The renter is liable for the first 500€ of any damage.
The Company itself assumes the full cost of vehicle damage regardless of fault, with no excess charge whatsoever (zero excess), subject to the exclusions listed below.
Both packages (CDW and FDW) are subject to the same limitations:
- Damage to the tyres and the underside of the vehicle (e.g. chassis, suspension) is never covered — it is always borne by the renter, regardless of the package chosen.
- Cover does not apply in case of a traffic code violation, driving under the influence of alcohol or substances, or intentional damage. In these cases, the renter bears full liability for the entire damage, regardless of the cover package selected.
Drive responsibly – we've got the rest covered.
Prohibited Vehicle Use
The vehicle may not be used for:
- Any unlawful activity whatsoever.
- Racing, performance testing, or off-road driving.
- Towing other vehicles or carrying excessive/hazardous loads.
- Sub-renting, allowing an undeclared driver to operate it, or transporting passengers for payment.
- Driving under the influence of alcohol, drugs, or medication that impairs driving ability.
- Transporting pets or animals inside the vehicle is prohibited, for reasons of allergies and hygiene for subsequent customers, unless expressly agreed in writing with the Company at the time of booking. Unauthorized transport of a pet will result in the renter being charged the cost of special cleaning/disinfection of the vehicle.
Breach of the above results in immediate termination of the rental, forfeiture of all insurance cover, and full liability of the renter for any resulting damage.
Traffic Violations & Fines
The renter is solely responsible for any traffic violation, fine, toll, or parking charge incurred during the rental. The Company is entitled to charge the corresponding amount to the renter's card or claim it from the renter, plus a reasonable administrative handling fee.
Additional Driver
Any additional driver must be declared in writing and meet the same age/licence requirements as the primary renter. Driving by an undeclared person constitutes unauthorized use and voids all insurance cover for the relevant incident.
Limitation of Company Liability
The Company is not liable for indirect, incidental, or consequential damages (e.g. loss of time, income, or opportunity) arising from use of the website or services, nor for delays, malfunctions, or events beyond its reasonable control. In any case, the Company's total liability towards the customer is limited to the amount paid for the specific rental.
Force Majeure
The Company is released from any liability for non-performance or delayed performance of its obligations due to force majeure events, including but not limited to natural disasters, strikes, government measures, pandemics, power/network outages, or failures of third-party service providers (e.g. payment systems).
Intellectual Property
All website content (text, images, logos, the "DriveUp" mark) belongs to the Company or its partners and is protected by intellectual property and trademark law. Reproduction, copying, or distribution without prior written approval is prohibited.
Data Protection
Customers' personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 and applicable Greek law, as detailed in the Company's Privacy Policy, which forms an integral part of these Terms.
Amendments to Terms
The Company reserves the right to amend these Terms at any time. Amendments take effect upon posting on the website. For active bookings, the terms in force at the time of booking apply.
Severability
If any provision is held invalid or unenforceable by a competent court, this does not affect the validity of the remaining provisions, which remain in full force.
Governing Law & Jurisdiction
These Terms are governed by Greek law. Any dispute shall be subject to the exclusive jurisdiction of the Courts of Mytilene, with the parties expressly waiving recourse to any other court.
